Terms of Service

1. Acceptance of Terms

By creating an account or using ArtistOS.studio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You must be at least 13 years old to use ArtistOS.studio. By signing up, you confirm that you meet this age requirement.

2. Description of Service

ArtistOS.studio is an AI-powered music marketing platform for independent artists. The Service allows you to upload songs, receive AI-generated marketing plans, create fan capture pages, send fan email blasts, and view post-release performance data. ArtistOS.studio does not distribute music to streaming platforms — distribution is your responsibility via your own distributor (e.g. DistroKid, TuneCore).

3. Your Account

You are responsible for maintaining the security of your account. ArtistOS.studio uses Clerk for authentication; you may sign in via Google, Apple, TikTok OAuth, or email and password. You are responsible for all activity that occurs under your account.

4. Your Content

You retain full ownership of all music, artwork, and other content you upload to ArtistOS.studio. By uploading content, you grant ArtistOS.studio a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the Service to you. We will never sell, license, or distribute your music without your explicit consent.

5. AI-Generated Content

ArtistOS.studio uses AI to generate marketing copy, hashtags, posting schedules, and content ideas. All AI-generated content is presented for your review and requires your explicit approval before being used. You are responsible for reviewing AI-generated content before acting on it. ArtistOS.studio makes no warranty that AI-generated content is accurate, original, or fit for any particular purpose.

6. Fan Email Lists

Fan email addresses collected through your ArtistOS.studio fan capture pages are owned by you. When a fan subscribes, ArtistOS.studio automatically derives their approximate location (city, region, country) from their IP address to help you understand your audience geography. No raw IP addresses are stored. You are responsible for complying with applicable email marketing laws (CAN-SPAM, GDPR, CASL) when sending email blasts. ArtistOS.studio provides infrastructure and mandatory compliance elements (unsubscribe links, consent records) but you remain the data controller for your fans' personal data.

7. Prohibited Uses

You may not use ArtistOS.studio to:

• Upload content you do not own or have rights to
• Send spam or unsolicited email to fans who have not opted in
• Violate any applicable law or regulation
• Attempt to reverse-engineer, scrape, or abuse the Service
• Impersonate another artist or person

8. Service Availability

ArtistOS.studio is provided "as is" during its Version 0 test period. We do not guarantee uninterrupted availability. Features may change or be removed. We will provide reasonable notice of material changes where possible.

9. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your content will be deleted within 30 days, except where retention is required by law.

10. Limitation of Liability

To the maximum extent permitted by law, ArtistOS.studio shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including lost revenue, lost data, or missed streaming opportunities.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
